Counsel to the victim does not replace the Public Prosecutor. The role is independent: representing the victim's interests, protecting procedural rights and presenting legally grounded requests throughout the proceedings.
Investigation and protection of rights
Representation may include preparation of the criminal complaint, access to the investigative file, submission of information, requests for investigative acts and review of prosecutorial determinations.
When legally available, the firm evaluates protective measures, precautionary relief and challenges to omissions or decisions that affect the victim's rights.
Hearings and intermediate stage
Representation includes preparation for and participation in hearings under Mexico's National Code of Criminal Procedure. During the written portion of the intermediate stage, after service of the accusation, the review may include formal participation alongside the prosecution (coadyuvancia), objections to formal defects, supplementary evidence and calculation of the reparation claim.
Full reparation of harm
The evidentiary strategy must identify the harm for which reparation is sought, the means by which it will be established and its relationship to the conduct at issue. The claim is developed with documentary, expert and legal support appropriate to the matter.
