Ordinary appeals
Review begins with the ruling, hearing record, arguments presented and legal provisions applied. This determines whether a remedy is available and whether grounds can be tied to a concrete procedural or substantive injury.
Constitutional relief through amparo
Amparo may be available against certain acts, omissions or rulings that affect constitutionally protected rights. Its viability depends, among other matters, on the nature of the challenged act, exhaustion requirements, standing, timeliness and statutory grounds for dismissal.
The strategy must distinguish between direct and indirect amparo and assess whether suspension of the challenged act may be requested and what effect it could have in the particular matter.
Precision of the challenge
An appeal requires precise identification of the asserted error, an explanation of its material effect and a request compatible with the relief legally available. Not every procedural disagreement constitutes a reviewable violation.
